TERMS & CONDITIONS
These Terms & Conditions apply to purchases made through chadkonik.com. By placing an order, you agree to the terms below.
ORDERS & PAYMENT
All prices are displayed in Australian dollars (AUD) unless otherwise stated.
Payment must be made in full at the time of purchase. Once your order has been confirmed, production may begin immediately as each print is made to order.
We reserve the right to cancel or decline an order where there has been a pricing error, payment issue, suspected fraud, or an artwork or edition is no longer available. If we cancel an order after payment has been received, the amount paid will be refunded.
LIMITED EDITIONS
Where an artwork is described as a limited edition, only the stated number of prints will be produced in that edition and size.
Limited-edition prints are individually hand-signed and numbered by the artist.
Once an edition has sold out, it will not be reproduced in that same edition.
MADE-TO-ORDER PRINTS
All prints are produced specifically for each order.
Please check artwork, size and order details carefully before completing your purchase.
Because prints are made to order, we do not accept returns, exchanges or cancellations for change of mind, incorrect size selection or other customer selection errors.
This does not exclude or limit any rights you may have under the Australian Consumer Law. ACCC
COLOUR & APPEARANCE
We make every effort to represent each artwork accurately online.
Colours, brightness and contrast may vary slightly depending on your screen, device and display settings. Minor variations between an on-screen image and the finished fine-art print are not considered faults.
PRODUCTION
Please allow up to 5-7 working days for production unless otherwise stated.
Custom and oversized works may require additional production time.
SHIPPING — AUSTRALIA
Shipping is free Australia-wide.
Orders are sent with tracking from Sydney, Australia. You will receive tracking information once your order has been dispatched.
Delivery times are estimates only and may vary depending on destination and carrier conditions.
INTERNATIONAL SHIPPING
International shipping is charged at a flat rate of A$50 per order, unless otherwise agreed for custom or oversized works.
International orders are sent with tracking.
International customers are responsible for any customs duties, import taxes, VAT/GST, brokerage fees, handling charges or other charges imposed by the destination country, customs authority or carrier.
These charges are not included in the purchase price or A$50 international shipping fee.
By placing an international order, you acknowledge and agree that you are responsible for paying any such charges that arise when your order enters the destination country.
Customs rules differ between countries, and we recommend checking your local requirements before purchasing.
This is consistent with how other Australian print sellers handle overseas taxes and duties; Australia Unseen, for example, states that local taxes or customs duties may be payable on delivery and are not included in its prices. Australia Unseen
CUSTOMS DELAYS
International orders may occasionally be delayed by customs or border authorities.
Customs clearance and processing times are outside our direct control.
If an order is returned to us because customs duties, taxes or other charges were not paid by the recipient, additional shipping or return costs may apply before the order can be resent, to the extent permitted by law.
DAMAGED OR INCORRECT ORDERS
Please inspect your order when it arrives.
If your print arrives damaged, defective or you receive the wrong artwork, please contact hello@chadkonik.com as soon as possible and include:
your order number
photographs of the artwork
photographs of the packaging
a brief description of the issue
We will assess the issue and, where appropriate, arrange a replacement, repair or refund in accordance with Australian Consumer Law.
Your rights under Australian Consumer Law are not limited by these Terms & Conditions. ACCC
RETURNS & CHANGE OF MIND
Because each print is made to order, we do not provide refunds or exchanges simply because you change your mind, select the wrong size or decide the artwork is no longer suitable.
Australian businesses are not generally required to provide a refund for change of mind, although statutory rights still apply where goods fail consumer guarantees. ACCC
CUSTOM ORDERS
Custom sizes, commissions and other bespoke works may be subject to separate pricing, production times and shipping arrangements.
Once a custom order has entered production, it cannot normally be changed or cancelled for change of mind.
Any additional terms agreed in writing for a custom order will form part of these Terms & Conditions.
FRAMING
Unless specifically stated otherwise, prints are supplied unframed.
Images showing artwork framed or displayed within an interior may be used for visualisation purposes only.
Please refer to the individual product description for exact dimensions and border sizes.
COPYRIGHT
Purchasing an artwork does not transfer copyright or reproduction rights.
All copyright and intellectual property rights in the photographs and artworks remain with Chad Konik.
Artwork may not be reproduced, copied, scanned, photographed for reproduction, commercially exploited, distributed or used to create derivative products without prior written permission.
This is also standard in art-print sale terms; Head On explicitly retains copyright and reproduction rights with the artist after a physical print is purchased. Head On Photo Festival
WEBSITE CONTENT
Images, photographs, artwork, text, branding and other content appearing on this website remain the property of Chad Konik or their respective rights holders and may not be reproduced or commercially used without permission.
DELIVERY DELAYS
We will take reasonable steps to produce and dispatch orders within the stated timeframe.
Delivery estimates are not guaranteed, and delays may occur because of postal services, couriers, customs, weather, peak periods or other circumstances outside our reasonable control.
Nothing in this section limits any rights available under applicable consumer law.
PRIVACY
Personal information provided when ordering is used to process your purchase, communicate with you and provide the services requested.
Please refer to our Privacy Policy for further information about how personal information is handled.
GOVERNING LAW
These Terms & Conditions are governed by the laws of New South Wales, Australia.
Nothing in these Terms & Conditions excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.
